          Terms and conditions from xkieke

          xkieke is a tradename, part of Kieke Schaaper, with the registered

          The terms and conditions apply on all the orders, deals and purchases that are made between xkieke and her

          customers through the webshop www.xkieke.nl and www.xkieke.com


          2. OFFERS

          2.1
          All the products from xkieke are limited editions.

          Regarding the availability of the products, xkieke reserves the right to terminate the agreement if the product is no 

          longer available. The customer in this case has the right to terminate the agreement as well.


          3. PRICES AND PAYMENT

          3.1
          All prices on the website xkieke are in euro’s and included 19% VAT.

          All prices are subject to change. Price changes do not affect current orders.
          If the customer is not in the country of dispatch, the customer is liable for any applicable sales tax and / or import 

          duties. There are also additional shipping charges for shipping outside The Netherlands.

          3.2
          All prices of the products on the website www.xkieke.nl and www.xkieke.com unless otherwise stated in the product 

          information, is excluding shipping and delivery costs.

          3.3
          You can pay with Ideal (only for customers with Dutch bankaccount), PayPal or banktransfer.


          4. DELIVERY
 
          4.1
          xkieke aims to deliver your order as soon as possible within 4 working days. Shipments outside The Netherlands will 

          take longer. Shipping is done by TNT (Dutch Royal Mail) to the address indicated on your order confirmation.

          4.2
          xkieke keeps the website updated as possible. It may happen that a product is no longer available. In this case, xkieke

          will contact you as soon as possible.

          4.3
          The delivery times given are only indicative. When delivery is not on time it does not entitle you to compensation or

          the right to cancel the order or the agreement, unless the delay in delivery is as such that you can not reasonably be

          expected to leave the agreement intact. In that case you are entitled to cancel the order.

          4.4
          Products will be send within The Netherlands, to Europe and the rest of the world.


          5. SENDING COSTS

          5.1
          For shipping of parcels within The Netherlands € 6,75 will be charged. For products that can go through the letterbox,

          the current postal rates apply, depending on weight and size.


          5.2

          For delivery outside The Netherlands there are additional shipping costs which depend on the destination country,

          weight and size.



          6. COMPLAINTS

          6.1
          In case of complaints xkieke will try to solve it directly in a good way. After determination of the complaint please

          contact directly.
 

          Complaints will be processed as follows:
          - Send an email to info@xkieke.nl
          - Mention in the e-mail the order number
          - Explain the complaint



          7. RETURNS AND EXCHANGES

          7.1
          If the ordered item is not what you expected or you are not satisfied with your purchase for any reason, then it is

          possible to return the item. Within 7 days after delivery you can return products (14 days for customers outside The 

          Netherlands). Then you will get the money refunded. The cost of return shipping are for the client’s account. If you

          want to exchange the item, the shipping will be paid by xkieke.

          7.2

          Returns are processed as follows:

          - Send within 7 days an email to: info@xkieke.nl telling us which article you want to return.
          - Specify the order number in the mail.
          - Wrap the undamaged and unused product (in original packaging), in a way that avoids damage.
          - The product(s) must be returned within 7 days after the report to xkieke (14 days for customers outside The 

             Netherlands).


         7.3
         In case you received another product than you ordered, you can exchange the products without any extra costs.

         Please contact within 2 days, by sending a mail to info@xkieke.nl info@xkieke.nl.

         7.4

         xkieke reserves the right to return products or to take only a portion of the amount of compensation where it is 

         suspected that the items by the customer or third parties are used or negligence, other than xkieke or supplier of the

         product, are damaged. The cost and risk of return shipping are for the client’s account.



         8. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS

         8.1
        The customer should respect the intellectual and industrial property rights attached to the xkieke products delivered

        unconditionally.

         8.2
         xkieke does not guarantee that the delivered products do not infringe any (unwritten) intellectual or industrial property

         rights of third parties.


         9. PRIVACY

         9.1
         All personal information will only be used for processing the order and will never be made available to third parties.


         10. LIABILITY

         10.1
         Any liability of xkieke and the products of xkieke for all damages of any kind, direct or indirect, including loss, 

         consequential damage to movable or immovable property or to any person, is specifically excluded. xkieke is not liable 

         for damages resulting from the execution of the contract caused by third parties.

         10.2
         xkieke assumes no liability for any damage arising from the use of products supplied by xkieke.

         10.3
         For misunderstandings, mutilations, delays or transmission of orders and notices resulting from the use of Internet or

         other communication traffic between client and xkieke, or between xkieke and others, as it relates to the relationship 

         between client and xkieke, xkieke is not liable unless it is a case of intent or gross negligence of xkieke.

 

         10.4

         Any liability of xkieke towards buyer can not in any case exceed the invoiced amount that the buyer under the 

         agreement relating to xkieke is due.



         11. FORCE MAJEURE
 
         11.1
         Without prejudice to its other rights, xkieke has in case of force majeure, the right, at its opinion, to suspend or

         terminate the contract without judicial intervention, by informing the client in writing to notify. In this case xkieke is

         not obliged to any compensation, unless standards of reasonableness and fairness determine otherwise.

         11.2
         Force majeure is defined as any deficiency that can not be blamed on xkieke, because it is not due to its fault and

         neither under the Dutch law, nor based on generally accepted practice.


         12. APPLICABLE LAW AND JURISDICTION

         12.1
         On all rights, obligations, offers, orders and agreements to which these conditions apply, as well as these conditions, 

         only Dutch law applies.

         12.2
         All disputes between parties will only be submitted to the competent court in The Netherlands.
 

 

         13. COLOURS

 

         13.1

         xkieke has made effort to display as accurately as possible the colours of the products that appear on the website. 

         However, due to variations in monitor display, we cannot guarantee that your display of colour will be accurate.
